The Criminal Complaints of the SPK (Capital Markets Board of Turkey). I don’t wish to hurt anyone. I just want to make up this enormous loss that has been the result of a huge mistake. As a businessman whose three companies have been listed on the stock market for three years and have gone public,offering shares internationally; a businessman who has visited more than 200 of the biggest foreign investment funds and given presentations to them, one of the most important issues, and one that I must be well-informed on, is the rules and regulations of the SPK and all related international law. I have never taken a risk regarding this matter. There hasn’t been a single irregularity.

When they could not find any irregularities in our financial tables, the SPK, who has been inspecting and auditing our group for nearly 10 years, made four criminal complaints in the last month pertaining to the past eight years as if they had never inspected us and as if there had never been a government commissioner on our general assembly and as if the decisions made had never been announced. In fact, all these criminal complaints prove that all our financial tables are correct. Because the tables that were announced were taken as the premise.

THE TRUSTEESHIP HAD TO BE ABOLISHED

Because the criminal complaints of the SPK are outside the scope of the bureau of constitutional crimes; and there is no lawful premise to constitute grounds for appointing a trustee or keeping one in position.

Another issue is this:

The criminal complaints of the SPK also relate to the last eight years. Each year, for the last eight years, the same decision has been made by the general assembly, with the participation of the government commissioner. It was officially announced and published, and there is an allotted time limit within which cases can be opened but we’ve long passed that deadline. Up until today, no case has been opened. Moreover, at the end of each year the general assembly has been acquitted.

Shouldn’t webe asking, if there is a mistake that has been repeatedly made over the last eight years, why didn’t you warn us within the allotted time limit?
